Terms of Service

KIDGE Terms of Service

Effective Date: March 18, 2026

Welcome to KIDGE. These Terms of Service (the "Terms") are entered into between you (the "Customer") and the KIDGE operations team ("we," "us," or "our"). By accessing, registering, or using the KIDGE platform (the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms.


1. Service and Account Management

1.1 Registration Obligations

You must provide true, accurate, and complete information during registration. Accounts are restricted to invited users only. The Customer is responsible for managing permissions for all sub-accounts (seats) under their account. Any actions performed using the Customer's credentials shall be deemed the actions of the Customer. KIDGE shall not be held liable for any data breaches resulting from improper internal permission management (e.g., failure to revoke access for departed employees).

1.2 Plan Descriptions

  • Standard Plan — Includes 200GB of download traffic per month.
  • Premium Plan — Includes 1TB of download traffic per month.

1.3 Payment Agent

KIDGE appoints Paddle as the authorized Merchant of Record. All payments, billing, and tax processing are subject to Paddle's Terms of Service and Privacy Policy.


2. Billing, Price Adjustments, and Plan Changes

2.1 No-Refund Policy

Except as otherwise provided in these Terms, all fees paid are non-refundable. Upon cancellation, the Service will continue until the end of the current billing cycle.

2.2 Right to Modify Prices

KIDGE reserves the right to adjust plan pricing at any time. Price changes will take effect in the next billing cycle, and we will notify you at least 30 days prior to the effective date.

2.3 Plan Upgrade Credits

When upgrading from Standard to Premium, the unused portion of the current cycle will be credited proportionally toward the new plan. The upgraded 1TB traffic quota will take effect immediately.

2.4 Plan Downgrades

Downgrade requests will take effect in the next billing cycle. No refunds will be issued for the remaining balance of the current cycle.


3. Usage & Refund Limitations

3.1 Fair Use Policy (FUP)

If an account exhibits abnormal download patterns (e.g., exceeding 500 requests per hour), KIDGE reserves the right to limit speeds, suspend links, or take necessary technical measures to ensure system stability and the rights of all users.

3.2 Refund Exclusion Threshold

In exceptional circumstances where a refund is requested or required by law, due to the nature of digital resource delivery, if an account has consumed more than 5% of the monthly quota, the Service is deemed to have been substantially fulfilled, and the account is automatically disqualified from refund eligibility:

  • Standard Plan — Consumption exceeding 10GB is non-refundable.
  • Premium Plan — Consumption exceeding 50GB is non-refundable.

3.3 Add-on Charges

All "Pay-As-You-Go" or one-time charges, including but not limited to Extra Bandwidth Packs and Additional User Seats, are incurred immediately upon purchase and are non-refundable.


4. Intellectual Property, Data Licensing, and Security

4.1 Content Ownership & Licensing

Drawings, models, and related data uploaded to the platform ("User Content") are 100% owned by you or the original rights holder. To maintain service operations (e.g., generating previews, collaborative transmission, backups), you grant KIDGE a worldwide, non-exclusive, royalty-free license to store, host, and process your content within the scope necessary to provide the Service, including through third-party service providers (e.g., AWS/GCP cloud storage, rendering engines).

4.2 Data Security

We commit to taking commercially reasonable security measures (such as AES-256 encryption) to protect your digital assets.

4.3 Data Retention & Post-Termination

Upon termination of subscription or account closure, KIDGE will retain your data for 30 days (the "Grace Period"). After the Grace Period, we reserve the right to permanently delete all content under the account. Extended retention or large-scale data migration may be subject to additional service fees.


5. Limitation of Liability & Professional Disclaimer

5.1 General Disclaimer

To the maximum extent permitted by law, KIDGE shall not be liable for any indirect, incidental, or punitive damages resulting from service interruptions, data loss, force majeure, or failures of third-party service providers.

5.2 Professional Decision Disclaimer

KIDGE serves solely as a technical tool for project management and data transmission and does not participate in the Customer's professional engineering, architectural, or legal decisions. KIDGE assumes no liability for construction defects, project delays, industrial accidents, or any contractual penalties resulting from errors in uploaded drawings, information asymmetry, or reliance on platform data.

5.3 Liability Cap

In no event shall KIDGE's total liability to the Customer exceed the total fees actually paid by the Customer to KIDGE in the 12 months preceding the dispute.


6. Modifications

KIDGE reserves the right to modify, update, or replace these Terms at any time. For "Material Changes" that affect your substantive rights or increase fee burdens, we will notify you via email or internal platform announcement at least 30 days before the changes take effect. Continued use of the Service after the effective date constitutes your acceptance of the new Terms. If you disagree with the modifications, your sole remedy is to stop using the Service and cancel your subscription before the changes take effect.
